This website acts as an intermediary platform where artworks are created and provided by individual artists. WWW Contemporary facilitates the sale and distribution of these artworks but is not responsible for the authenticity or quality of the artworks unless explicitly stated. Any disputes regarding the artwork itself should be directed to the artist, not WWW Contemporary. If we sell our own merchandise (WWW Contemporary branded products), it will be clearly indicated which products are created by artists and which are our own products.

Copyright and Usage Rights

All artwork sold on the website is protected by copyright law. Purchasing a piece of art does not transfer copyright ownership to the buyer. Any reproduction or use of the artwork beyond personal enjoyment is prohibited without the artist’s explicit permission.

 

Copyright:

The copyright remains with the artist and is not transferred to the buyer. This means that while the buyer gains ownership of the physical artwork, they do not have the rights to copy, distribute, modify, or publicly display the artwork without the artist’s explicit permission. The sale of an original artwork through our services does not constitute the transfer of intellectual property or copyright to the owner of a physical or digital copy of the artwork. Additionally, purchasing the artwork does not grant the buyer any rights to commercial use without the artist’s consent.

Country-Specific Practices:

We adhere to the copyright laws and practices of each country, including the artist’s resale right (droit de suite) and the artist’s right of access, where applicable. We respect these rights and obligations in accordance with the laws of the respective countries.

Taidevälitys HEL Oy / WWW Contemporary acts solely as an intermediary for the sale of artworks and is not responsible for any copyright infringements or breaches of local rights, such as the resale right or the artist’s right of access, committed by the buyer. It is the buyer’s responsibility to ensure compliance with copyright laws and practices.

Customer Data and Privacy:

The handling of customer data is important to us. If customer data needs to be shared with the artist to facilitate the artist’s right of access or other rights, this will always be done in compliance with applicable laws, such as GDPR (or equivalent data protection laws), particularly in Europe. Customers will be informed if their data is shared with the artist in these cases.

Moral Rights of the Artist:

The buyer must respect the moral rights of the artist, including the right to be recognized as the creator of the artwork and the right to prevent the artwork from being altered or used in a way that could harm the artist’s reputation.

Resale:

If the buyer resells the artwork, they must inform the new buyer of the artist’s copyright and other rights related to the artwork.

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Finland. These Terms also comply with the General Data Protection Regulation (GDPR) of the European Union, ensuring the protection and processing of customers’ personal data.

 

Cargo Insurance

General Overview of the Insurance:

Artworks sold through Taidevälitys HEL Oy (WWW Contemporary) are insured under the following terms. The insurance is provided by IF Vahinkovakuutus Oyj (Business ID: 1602149-8).

If’s cargo insurance is valid for the benefit of the user of the online art marketplace WWW Contemporary when goods purchased from the service are delivered to them as agreed.

Insurance Validity During Transport:

The insurance begins when the artwork is moved from its storage location to the transport vehicle and ends when the artwork is placed in the final storage location at its destination, or 60 days after the artwork is unloaded at the destination.

The insurance also covers return transport in case of complaints if the original transport was insured.

Geographical Area:

The insurance is valid in Europe and worldwide but does not cover transports to or from Belarus, Russia, the Donetsk and Luhansk regions, the Crimean Peninsula, Kazakhstan, Turkmenistan, Kyrgyzstan, Uzbekistan, and Azerbaijan. It also does not cover storage or transport in Ukraine.

Insurance Coverage: 

Traffic Accident, General Average, and Catastrophe: Fire, explosion, lightning strike, earthquake, volcanic eruption, landslide or snow slide, vehicle accident, jettison or washing overboard, general average contributions, salvage and towing operations, and legal costs.

Total Loss During Loading/Unloading:

Water intrusion into the transport vehicle, artwork falling during loading/unloading leading to total loss, unloading in an emergency port, theft, or rain damage while stored in an emergency port.

Theft During Transport: Theft, pilferage, or other criminal acts. 

Breakage During Transport: Damage such as breaking, bending, denting, or cracking due to an external event.

All Risks (Transport): Sudden and unforeseen physical damage to the transported artwork caused by external factors.

War: Damage and costs due to war weapons, actions of a warring state, civil war, revolution, rebellion, or political sabotage.

Strike and Sabotage: Damage, loss, or costs caused directly by strikes, lockouts, riots, civil unrest, looting, terrorism, or sabotage.

Insurance Amount and Deductible:

The insurance amount is specified in the insurance policy, and the deductible is subtracted from each claim.

Compensation is based on the artwork’s insured value, which includes transport costs and the insurance premium.

Protection Guidelines:

Packaging and Protection: The artist must ensure that the artwork is properly protected, packaged, secured, and prepared for transport. The artwork must be protected from shocks and other external damages.

Transport Vehicle: The transport vehicle or unit must be suitable for the safe transport of the specific artwork.

Compliance with Instructions: The artist must follow instructions and regulations provided by If Insurance or the relevant authorities.

Consequences of Negligence: If protection guidelines are not followed and this results in damage, If Insurance’s liability is limited to the part of the damage that would have occurred even if the guidelines had been followed.

Obligations in the Event of Damage:

In the event of damage, the artist must make a written notification to the carrier and take necessary measures to investigate the damage.

A compensation claim must be submitted to the insurance company within six months of the transport’s completion.

Determination of Compensation:

If Insurance will determine whether the damaged artwork is to be repaired, replaced with a similar item, or compensated financially.

Compensation is based on the market value or the invoice value of the artwork.

Additional Considerations:

The artist must notify the insurance company if the insured artwork is later found or recovered.

If Insurance has the right to reclaim compensation if the artist has waived their right to claim compensation from third parties.

Availability of Insurance Terms:

The artist has the right to request the complete insurance terms for review.

This agreement binds the artist to comply with all insurance terms.
